Hiring workers from Pakistan: Protector of Emigrants registration, the chef and cook assessment rule, English and the visa steps

Pakistan sends Australia software and IT professionals, engineers, accountants and doctors above all, with nurses, chefs and cooks behind them, and a fast-growing international-student population means a rising share of candidates are already onshore. Two rules shape an offshore hire. On the Australian side, the Department’s mandatory skills-assessment instrument lists Pakistani passports for Chef and Cook, so a Trades Recognition Australia assessment must be in hand before the 482 nomination for those two occupations (the other trades are not listed for Pakistan). On the Pakistani side, emigration for employment is governed by the Emigration Ordinance 1979 and the Bureau of Emigration and Overseas Employment, under which a worker leaving on an employment visa is registered with the Protector of Emigrants, either through a licensed Overseas Employment Promoter or directly where the worker found the job themselves.

Candidate context: visa sponsorship jobs from Pakistan.

The Pakistani side: the Bureau of Emigration and the Protector of Emigrants

The Bureau of Emigration and Overseas Employment, under the Ministry of Overseas Pakistanis and Human Resource Development, administers the Emigration Ordinance 1979. Recruitment through an agency runs through a licensed Overseas Employment Promoter, who lodges the employer’s demand letter and power of attorney, attested by the Pakistani mission in the employer’s country, with the Protector of Emigrants for permission before recruiting. A worker who found the job directly registers with the Protector of Emigrants on the direct-employment route, presenting the visa and employment contract, paying the Overseas Pakistanis Foundation welfare contribution and the state life insurance premium, and receiving the Protector’s registration that immigration checks at departure. In practice the registration is applied to employment visas, and skilled workers leaving on a 482 should confirm with the Bureau or the Pakistan High Commission in Canberra whether and how it applies to their case, because practice has varied; it also gives the worker access to the Foundation’s welfare benefits. No Australian employer may recover sponsorship costs from the worker, and recruitment fees charged to Pakistani workers by intermediaries are the sector’s chronic abuse: put in writing that the worker pays nothing for the job.

The chef and cook assessment rule, and English

The Department’s instrument makes a skills assessment mandatory for a 482 nomination where it lists the occupation for the applicant’s passport. For Chef (351311) and Cook (351411) the listed passports include Pakistan, Bangladesh, Nepal and India, so a Pakistani chef must hold a positive Trades Recognition Australia assessment (A$795, typically around 120 days, on qualification plus documented employment) before you nominate; plan it from day one. Pakistani passports are not listed for the metal, automotive or electrical trades, so those are nominated on evidence, with TRA required only for the 186 Direct Entry. English for the 482 is IELTS 5.0 overall and in each component or equivalent; most Pakistani professionals test, though graduates of English-medium universities can use the study-based exemption (five years of full-time English-medium secondary or tertiary study) with institution letters, and nurses and doctors must meet the registration standard regardless.

The Australian side, step by step

  1. Confirm the occupation and the salary floor of A$79,423 or the market rate: sponsored jobs by occupation.
  2. Labour market testing: two advertisements of at least 28 days on platforms with national reach within the four months before nomination (Pakistan has no exemption): labour market testing.
  3. TRA assessment for chefs and cooks; Ahpra registration for nurses and doctors before grant.
  4. Standard Business Sponsorship (A$420), nomination (A$330 plus the Skilling Australians Fund levy of A$1,200 per visa year under A$10m turnover), visa (A$4,015 for a 482; A$6,140 for a 494 or 186), with health examinations and a Pakistani police character certificate.
  5. In parallel, the Protector of Emigrants registration on the Pakistani side, so the worker can depart on grant.

Full costs: cost to sponsor a worker. Timeline: how long sponsorship takes, adding the TRA period for chefs.

The onshore pool: students, graduates and professionals already here

Pakistani students are concentrated in IT, engineering, business and accounting, and a 485 graduate with an Australian degree has Australian references, meets the English requirement by study, and needs no Pakistani emigration step; the same is true of the skilled migrants and partners already here. For most occupations that is the fastest Pakistani hire by far. Employing international students; sponsoring an existing employee when the 485 runs out.

Frequently asked questions

Does a Pakistani chef need a skills assessment before a 482 nomination? Yes. The Department’s mandatory skills-assessment instrument lists Pakistani passports for Chef and Cook, so a positive Trades Recognition Australia assessment (A$795, around 120 days) must be held before the nomination is lodged. Other trades are not listed for Pakistan.

Is there a Pakistani government process for hiring a Pakistani worker? Yes. Under the Emigration Ordinance 1979 a worker leaving on an employment visa is registered with the Protector of Emigrants, through a licensed Overseas Employment Promoter (who lodges the attested demand letter and power of attorney) or directly where the worker found the job themselves. Confirm current practice for a 482 with the Bureau of Emigration or the High Commission in Canberra.

Do Pakistani workers need an English test? Usually yes: IELTS 5.0 overall and in each component or equivalent for the 482 Core Skills stream, unless they completed five years of full-time English-medium secondary or tertiary study. Nurses and doctors must meet the Ahpra standard regardless.

Do I need labour market testing for a Pakistani candidate? Yes. Pakistan has no trade-agreement exemption: two advertisements of at least 28 days each on national-reach platforms within the four months before nomination.

Are Pakistani engineering degrees recognised in Australia? Degrees accredited by the Pakistan Engineering Council are recognised under the Washington Accord, of which Pakistan has been a full signatory since 2017, so Engineers Australia assesses them on the accredited-qualification pathway rather than by competency demonstration report.
