1. About SponsorTalent

SponsorTalent.com.au ("the Platform") is an online marketplace that connects Australian employers seeking to sponsor overseas workers with skilled candidates seeking employer sponsorship. The Platform is operated by Keshab Chapagain, a registered migration agent (MARN 1576536) registered with the Office of the Migration Agents Registration Authority (OMARA) under the Migration Act 1958 (Cth).

2. How the Platform Works

For Candidates

• Candidates can register on the Platform free of charge.
• Candidate profiles are displayed anonymously — your name, email, phone number, and other contact details are never shown publicly.
• Employers may view your anonymous profile (occupation, experience, qualifications, skills summary).
• When a candidate or agent pays to unlock an employer's contact details, those details are shared with the paying party.
• You will be notified when an employer unlocks your profile.
• Candidates are never charged any fees by SponsorTalent.

For Employers

• Employers can register and browse candidate profiles free of charge.
• Candidate profiles are displayed anonymously. Contact details (name, email, phone) are hidden.
• Employers list for free. Employer contact details (company name, contact person, email, phone) are hidden from the directory.
• Candidates and migration agents pay a connection fee to unlock an employer's contact details. The connection fee is non-refundable once the contact details have been revealed.
• Employer contact details (contact person name, email, phone) are never displayed publicly on the Platform. Only the business name, industry, location, and role information are shown.
• Payment is processed securely via Stripe.

3. Privacy and Data Protection

• Candidate contact details are stored securely and only shared with employers who have paid the connection fee.
• Employer contact details are stored securely and are never shared publicly or with candidates.
• All personal data is handled in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

4. Fees and Payments

• Candidate registration: Free. Candidates are never charged.
• Employer registration: Free.
• Connection fee (candidate unlock): As displayed on the Platform at the time of purchase. Currently $30 AUD per candidate.
• Connection fees are non-refundable once contact details have been revealed.
• All prices are in Australian Dollars (AUD) and include GST where applicable.
• Payments are processed by Stripe. SponsorTalent does not store your credit card details.

5. Migration Services

• Migration advice and visa application services are provided by Keshab Chapagain (MARN 1576536), not by the Platform itself.
• The AI chatbot on the Platform provides general information only and does not constitute migration advice.
• Migration agent fees for visa applications are separate from Platform fees and are agreed directly between the client and the migration agent.
• Consultation fees may apply for personalised migration advice.

6. Age Requirement

You must be at least 18 years of age to use SponsorTalent. By registering, you confirm that you are 18 or older.

7. User Obligations

• You must provide accurate and truthful information when registering.
• You must not use the Platform for any unlawful purpose.
• Employers must not contact candidates whose details they have not unlocked.
• Users must not scrape, copy, or redistribute information from the Platform.

8. Marketplace Only — No Guarantee of Outcomes

SponsorTalent is a marketplace platform only. It is not a migration agent service and does not provide migration advice. Use of the Platform does not constitute a client-agent relationship with any migration agent.

• SponsorTalent does not guarantee employment for candidates or successful hiring for employers.
• SponsorTalent does not guarantee visa approval or any particular migration outcome.
• The Platform facilitates introductions only. All visa and sponsorship decisions are made by the Department of Home Affairs.
• Migration advice, if sought, is provided separately by registered migration agent Keshab Chapagain (MARN 1576536) under a separate client-agent agreement.

9. Disclaimers

• SponsorTalent does not guarantee that any candidate will be hired or that any visa application will be successful.
• The Platform facilitates connections between employers and candidates. The outcome of any sponsorship arrangement depends on individual circumstances, visa eligibility, and Department of Home Affairs decisions.
• Information provided by the AI chatbot is general in nature and may not reflect the most current migration regulations.

8. Limitation of Liability

To the maximum extent permitted by law, SponsorTalent's liability for any claim arising from the use of the Platform is limited to the amount of fees paid by the user to SponsorTalent in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Platform at any time if you breach these Terms. You may request deletion of your profile at any time by contacting us.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
