Recruitment Agency Guide to 482 Sponsorship — What Agencies Can and Cannot Do
Recruitment Agencies and Sponsorship — The Big Question
One of the most common questions agency directors ask is: can our recruitment agency directly sponsor a 482 visa worker? The answer is more nuanced than yes or no. It depends on whether the agency is the actual employer of the worker, or simply the intermediary between the worker and the end employer.
Direct Sponsorship by a Recruitment Agency
A recruitment agency can sponsor a worker on a 482 visa if the agency is the direct employer — meaning the agency pays the worker, manages the employment relationship, and is the entity named on the nomination. This is uncommon for traditional recruitment agencies because they typically place workers with client companies rather than employing them directly.
Labour Hire and On-Hire Arrangements
The more common model is on-hire labour. In an on-hire arrangement, the agency employs the worker but on-hires them to a client company. Under Australian law, on-hire labour for 482 sponsorship usually requires an On-Hire Labour Agreement — a special agreement with the Department of Home Affairs that allows the agency to nominate workers it will on-hire to third-party hosts.
On-Hire Labour Agreements are not granted routinely. The agency must demonstrate:
- Established trading history and financial viability
- A genuine need for sponsored labour across multiple host businesses
- Robust governance, including written agreements with host employers
- Compliance with sponsor obligations across the entire on-hire chain
What Recruitment Agencies Cannot Do Without a MARN
Under the Migration Agents Registration Authority (MARA) framework, only Registered Migration Agents — or Australian legal practitioners — can give immigration assistance for a fee. Recruitment agencies that do not employ a MARN-registered agent are legally restricted from:
- Advising candidates on visa eligibility
- Helping with visa application forms
- Lodging sponsorship, nomination, or visa applications
- Communicating with the Department of Home Affairs on a candidate behalf
This is not a technicality. Providing unregistered immigration assistance is a criminal offence with significant penalties. Most recruitment agencies handle this by partnering with a registered migration agent for the visa component.
What Recruitment Agencies Can Do
There is a wide and valuable scope of activity that agencies can carry out:
- Source and screen candidates for sponsorship-ready criteria (skills, experience, English, age)
- Brief candidates on the general structure of sponsorship visas
- Match candidates to sponsoring employers
- Manage the recruitment process — CV review, interview coordination, reference checks, offer negotiation
- Facilitate the handoff to a registered migration agent for the visa pathway
- Provide commercial advice to clients about the cost and timeline of a sponsored hire
The Cleanest Model for Most Agencies
Rather than pursue an On-Hire Labour Agreement (which is administratively heavy), most recruitment agencies take a simpler route:
- Source and pre-screen sponsored candidates for client employers
- The client employer becomes the sponsor and nominator
- A registered migration agent (in-house or partnered) handles the visa pathway
- The agency takes a placement fee from the employer
This keeps the agency in its strength (sourcing and matching) and outsources the regulated component (immigration advice and lodgement) to the right specialist.
